Two agencies within the U.S. Department of Labor enforce parts of the ADA. The Office of Federal Contract Compliance Programs (OFCCP) has coordinating authority under the employment-related provisions of the ADA. The Civil Rights Center (CRC) is responsible for enforcing Title II of the ADA as it applies to the labor- and workforce-related practices of state and local governments and other public entities. The Department of Justice’s revised regulations for Titles II and III of the Americans with Disabilities Act of 1990 (ADA) were published in the Federal Register on September 15, 2010. These regulations adopted revised, enforceable accessibility standards called the 2010 ADA Standards for Accessible Design, "2010 Standards." On March 15, 2012, compliance with the 2010 Standards was required for new construction and alterations under Titles II and III. March 15, 2012, is also the compliance date for using the 2010 Standards for program accessibility and barrier removal.
I should mention one caveat to all of this. Businesses that are required to comply but don't have the ability to bring their websites into compliance can provide an accessible alternative to provide the same information, goods, and services that they provide online, like a staffed phone line. The trick, however, is that this option has to provide at least equal access, including in terms of hours of operation. And, as we know, the internet is around 24/7, so good luck with that. 
Nice Article! It is very important to work under guidelines if you don’t want to get sued and don’t want to pay the penalties. But more importantly it is better to give each user hassle free user experience over your website. Being ADA Compliant means your website works well for people with disabilities and they can easily access and navigate your website.
In recent cases, the U.S. Department of Justice has repeatedly sided with plaintiffs arguing that a private company’s website needs to be accessible, despite any other mitigating factors. One thing is for certain, however: The number of federal lawsuits alleging violations of the ADA is currently accelerating at a rapid pace. Between January and August 2017, there were 432 ADA lawsuits filed in federal court—more than the total number of ADA lawsuits in 2015 and 2016 combined.
Updated regularly to fully meet ADA standards, WP Accessibility addresses persistent WordPress theme compliance challenges. Among other things, you can: enable (or add) Skip links with WebKit by adding JavaScript to move keyboard focus; add language and text direction with HTML attributes; add toolbar toggling between high contrast, large print, and grayscale (desaturated) views; and even add long descriptions to images. We not only referenced the ADA’s requirements while building the website, but also sat down one-on-one with users who are blind to see how they navigated the site. These individual sessions were invaluable and provided more insights than just the law’s basic requirements. Instead of making assumptions about how these users would interact with the site, we took the time to observe their real interactions and used that data to formulate new features.
Imagine struggling to do something as simple as navigating and reading a website, when you’re suffering from Glaucoma, Cataracts, Macular degeneration, Retinal disorders, Refractive errors, Optic nerve disorders, and other eye issues. Reading the text in order to gain knowledge and information, would be tiring at the least. Your website doesn’t need to be like that, in fact, your website can be a pleasant experience where the visually impaired can easily zoom in and out on every page or, the text to speech feature will convert to the audible voice that you are listening to right now.
You can test specific themes for compliance with these guidelines using a tool such as the WAVE Web Accessibility tool.  For sites that require 100% compliance, we recommend testing your theme of choice using the demo page for the theme, for example Twenty Fourteen. We also recommend using Header Text (displaying the Site Title), rather than a Header Image, as some WordPress.com themes will not provide AltText and therefore generate an error in the accessibility tool when a Header Image is set.
The 2014 case involving Peapod, an online grocery retailer emphasizes that being ADA compliant goes beyond your website. The settlement required Peapod to make its mobile applications accessible by March 2015 and its website accessible by September 2015. Since mobile apps are fast becoming the preferred method of online shopping, e-commerce sites must focus on app accessibility too.

It provides improved accessibility to a vast audience of people who might not otherwise have their own assistive technology, such as people who are not native to the language of the page, or people with dyslexia or other reading challenges.
Is your website accessible to ALL users? The Americans with Disabilities Act (ADA) of 1990 prohibits discrimination based on disability. As I mentioned above, under each WCAG 2.1 principle is a list of guidelines, and under each guideline are compliance standards, with techniques and failure examples at each level. Some guidelines include only Level A items; others include items for multiple levels of conformance, building from A to AAA. At each stage, you can easily see what more you would need to do to reach Level AA or AAA. In this way, many websites include elements at multiple levels of accessibility.
When choosing an aid or service, title II entities are required to give primary consideration to the choice of aid or service requested by the person who has a communication disability. The state or local government must honor the person’s choice, unless it can demonstrate that another equally effective means of communication is available, or that the use of the means chosen would result in a fundamental alteration or in an undue burden (see limitations below). If the choice expressed by the person with a disability would result in an undue burden or a fundamental alteration, the public entity still has an obligation to provide an alternative aid or service that provides effective communication if one is available.
I have a membership website teaching martial arts. It is accessible only to people who pay a monthly membership fee. I recently had a gentleman in Malta ask if I could make more than 850 videos on the site accessible to him (he is visually impaired). That is an impossible task for a one-man business. If I understand this article correctly, my site is not required to be accessible?

All public-facing websites should evaluate and consider compliance with ADA laws related to their industry. That is, your website should aim to be accessible to users with a disability. Failure to comply with this requirement can lead to potential legal issues and challenges, particularly in some industries. Fortunately for WordPress site owners, there are at least a dozen plug-ins specially designed to help you achieve greater measures of ADA compliance with minimal costs and work involved. The following are five options to consider to make your WordPress website ADA compliant.

The pressure is mounting to implement technology that more directly connects with residents, but balancing the shift to enable all citizens – including the approximately 19 percent with disabilities – can seem insurmountable. Beyond ensuring your organization is doing right your community, being in compliance with the Americans with Disabilities Act (ADA) or Section 508 standards is daunting – especially with the threat of a fine or lawsuit for non-compliance.
Complying with ADA provisions will cost you time, money, and human effort. Based on the audit results, you will know accurately the amount of time, human effort, and money you need to invest in compliance. Armed with these facts, you can start budgeting for the above three forms of cost—time, money, and human effort. This will require a clear roadmap.
A critical and often overlooked component of ensuring success is comprehensive and ongoing staff training. Covered entities may have established good policies, but if front line staff are not aware of them or do not know how to implement them, problems can arise. Covered entities should teach staff about the ADA's requirements for communicating effectively with people who have communication disabilities. Many local disability organizations, including Centers for Independent Living, conduct ADA trainings in their communities. Although the plugin works, we activated the white label solution. They said: For only $10 you can modify the widget footer, remove the donate link and enable other customizations From then and on they charge me every single month 10$, they don't reply to my messages and the so called "Manage" menu has been disappeared from the widget... While the U.S. Department of Labor's (DOL) Office of Disability Employment Policy (ODEP) does not enforce the ADA, it does offer publications and other technical assistance on the basic requirements of the law, including covered employers’ obligation to provide reasonable accommodations to qualified job applicants and employees with disabilities. The menu is fully keyboard accessible and contrast levels for text are kept well above the 4.5:1. This theme passes WCAG 2.0 AA standards out-of-box. On wordpress.org, Period is given the “accessibility-ready” tag. This is basically a reminder to users that while all design elements in Period pass accessibility standards, it’s up to the user to make sure their content is accessible too in order for their site to maintain its accessibility.
Attitudes toward digital accessibility have evolved over time. In 2010, the Justice Dept. said they would address the topic. They said the ADA covers web sites, including companies that don’t have brick and mortar presences. They said companies can comply with the law by offering an alternative means of access, so if a web site isn’t ADA compliant, they could offer 24/7 phone access as an example of alternative access.
Reha asked Vu if companies are obligated to comply? Vu said that unlike the physical access world, where any new building has to be compliant no matter what, there’s no such thing in the web world. The Justice Dept. hasn’t said that that’s the default, but they have said that the current regulatory regime requires it anyway. Equal access has been around since 1990.
