For people who are deaf, have hearing loss, or are deaf-blind, this includes providing a qualified notetaker; a qualified sign language interpreter, oral interpreter, cued-speech interpreter, or tactile interpreter; real-time captioning; written materials; or a printed script of a stock speech (such as given on a museum or historic house tour). A “qualified” interpreter means someone who is able to interpret effectively, accurately, and impartially, both receptively (i.e., understanding what the person with the disability is saying) and expressively (i.e., having the skill needed to convey information back to that person) using any necessary specialized vocabulary.
Talk to your web designer about other techniques that will make your site more user-friendly for people with disabilities. Worried that’s not in your budget? Consider the fact that DOJ fines start at $75,000. And it's still yet to be determined if a non-compliant website is liable for one fine or will be charge per page for each violation. As the recent lawsuits illustrate, though, settlements quickly add up into the millions.

The large number of people who have disabilities, coupled with the challenges that they face, is one of the reasons that the Americans with Disabilities Act (ADA) was passed in 1990.² As its name suggests, the ADA is designed to protect individuals with disabilities in the United States. The ADA essentially makes it illegal for any government entity or business to provide goods and services to the general public without ensuring that the entities are accessible by people with disabilities. In today’s digitally driven world, many businesses fail to follow web accessibility best practices. In fact, this is why the Supplemental Advanced Notice of Proposed Rulemaking (SANPRM) was created by the U.S. Department of Justice (DOJ). To ensure that they are implementing digital accessibility best practices, organizations are encouraged to use the WCAG 2.1 technical requirements.³

The ADA guidelines are often updated so that businesses can better understand how various disabilities can affect the way that people will interact with websites and digital content. The guidelines also explain why certain barriers can prevent disabled individuals from using or even accessing a website. With these goals in mind, it is important to note that organizations need to review the guidelines on a yearly basis. New technologies, such as Artificial Intelligence10, are being used to help people with disabilities get the most out of the digital world. If organizations fail to read the latest ADA guidelines, then they will soon discover that their approach to web accessibility is outdated, and they might be in violation of digital accessibility laws.

Covered entities are required to provide aids and services unless doing so would result in an “undue burden,” which is defined as significant difficulty or expense. If a particular aid or service would result in an undue burden, the entity must provide another effective aid or service, if possible, that would not result in an undue burden. Determining what constitutes an undue burden will vary from entity to entity and sometimes from one year to the next. The impact of changing economic conditions on the resources available to an entity may also be taken into consideration in making this determination.
Accessibility on the web can mean a lot of things. But in general it means making websites as inclusive to as many users as possible. Accessibility is important for a diverse group of users including mobile users, people who rely on assistive technology to navigate the web, and even search engine robots. We handle accessibility of WordPress.com in two simple ways.
We not only referenced the ADA’s requirements while building the website, but also sat down one-on-one with users who are blind to see how they navigated the site. These individual sessions were invaluable and provided more insights than just the law’s basic requirements. Instead of making assumptions about how these users would interact with the site, we took the time to observe their real interactions and used that data to formulate new features.

Many deaf-blind individuals use support service providers (SSPs) to assist them in accessing the world around them. SSPs are not “aids and services” under the ADA. However, they provide mobility, orientation, and informal communication services for deaf-blind individuals and are a critically important link enabling them to independently access the community at large.
In many situations, covered entities communicate with someone other than the person who is receiving their goods or services. For example, school staff usually talk to a parent about a child’s progress; hospital staff often talk to a patient’s spouse, other relative, or friend about the patient’s condition or prognosis. The rules refer to such people as “companions” and require covered entities to provide effective communication for companions who have communication disabilities.

This is a very cool feature, and makes the site accessible to millions of people who would otherwise be excluded due to language. However, it's a little buggy. Selecting some of the languages (e.g., " Slovenčina") does not result in translated text on the home page, but does result in a changed lang attribute, so screen readers that support the selected language will pronounce the English text using the new language's speech engine, which is not likely to be intelligible.
Upon discovering issues faced by disabled government employees and the public, revisions to section 508 were made. The issues that were uncovered involved websites, documents, and software programs. As of January 2018, the updated 508 standards require all federal agencies and contractors to create web content accessible to all. The updated standards also include Website 508 compliance.

Case law has been the most helpful in illuminating the implications of the ADA for websites.There have been lawsuits involving companies like Expedia, Hotels.com, Southwest Airlines, and Target as defendants and primarily featuring accessibility organizations as plaintiffs. These cases had mixed results, but each helped clarify the ADA's jurisdiction on the web. 
The 2014 case involving Peapod, an online grocery retailer emphasizes that being ADA compliant goes beyond your website. The settlement required Peapod to make its mobile applications accessible by March 2015 and its website accessible by September 2015. Since mobile apps are fast becoming the preferred method of online shopping, e-commerce sites must focus on app accessibility too. 
It will annotate all the elements of a web page and point out any issues. The other tool is WAVE, which will provide you with a detailed accessibility analysis of the current page. Each tool will have its own button displayed on the bottom of your site to logged in users (you can choose which user roles will see the buttons). Just click the button of your choice to start analyzing.
Accessibility by UserWay UserWay creates a simpler and more accessible browsing experience for users with mobility issues. Millions of people cannot use a mouse or other pointing device and rely solely on their keyboard to navigate websites. Your site should be fully navigable using a keyboard’s tab key, arrow keys, the enter key and the space bar.
An example is Patagonia Works, Inc. which had a complaint for a permanent injunction filed against it in the United States District Court stating, Under Section 302(b)(1) of Title III of the ADA, it is unlawful discrimination to deny individuals with disabilities an opportunity to participate in or benefit from the goods, services, facilities, privileges, advantages or accommodations, which is equal to the opportunities afforded to other individuals. 42 U.S.C. 12182 (b)(1)(A)(ii). Below is a summary of what the lawyers asked the court for.

The WCAG is created by the W3C to provide a standard for web content accessibility that can be shared around the world. The WCAG is meant to accompany organizations as a sort of blueprint on how to make their websites ADA compliant.

Up-to-date standards are offered for checking compliance, and it provides a cost-effective way to scan a site for compliance. There's services out there where it'd cost more than $150 (the current cost of a 1 site 1 year license) for the size of the sites I'm working with. I'm very happy to see this offering in the first place, and it's even nicer to see how thorough it looks to be. Of course, it's not perfect so I'd love to see more of the WP.org listing fleshed out (the developer author/contributor mention is missing, etc.), I'd love to see the free version on GitHub (or similar for community development assistance [I have a few things I'd help with] which is very nice to see in a WP.org listing to show there's support / ongoing development for the plugin), and of course I'd love to see the server-side checker come to feature-parity with WAVE (currently WAVE is showing a few things the server-side checker doesn't have [color contrast, etc.]) Keep up the great work!
It’s most outward feature is a font size and color contract toolbar that helps users more easily read your content. But it also does a lot of behind-the-scenes work like adding skip-to-content links, implementing an outline to the link :focus state for better keyboard navigation, utilizing longdesc for images and a whole lot more. Each feature can be turned on or off through a settings page.

Public accommodations include most places of lodging (such as inns and hotels), recreation, transportation, education, and dining, along with stores, care providers, and places of public displays.
Hey Casey, this is one of the areas where things get a little weird because the W3 doesn’t actually have any say over the ADA guidelines, it is more than the ADA guidelines adopted the WCAG 2.0 guidelines as just that, a guideline to help. As far as I know, the tool you’ve linked to hasn’t been used in any judgements I’m aware of. Usually when it comes down to making a decision on if something is/isn’t compliant they have people use the actual PAWS tools and show what elements do/don’t work as intended or are otherwise inaccessible. The ADA requires that title II entities (State and local governments) and title III entities (businesses and nonprofit organizations that serve the public) communicate effectively with people who have communication disabilities. The goal is to ensure that communication with people with these disabilities is equally effective as communication with people without disabilities.
