Based on what we’ve seen if you don’t have a physical retail or service location, and you don’t receive any funding from the government you likely aren’t required to have a website that would be considered compliant. A person’s method(s) of communication are also key. For example, sign language interpreters are effective only for people who use sign language. Other methods of communication, such as those described above, are needed for people who may have lost their hearing later in life and do not use sign language. Similarly, Braille is effective only for people who read Braille. Other methods are needed for people with vision disabilities who do not read Braille, such as providing accessible electronic text documents, forms, etc., that can be accessed by the person’s screen reader program.
The situation has now emboldened many people. She is dealing with tons of demand letters going out across the country. Businesses have been caught off guard because they thought they had time to deal with this and become compliant, and now the Justice Dept. basically says they have to be compliant now. As soon as they deal with one plaintiff, another comes along.

In recent cases, the U.S. Department of Justice has repeatedly sided with plaintiffs arguing that a private company’s website needs to be accessible, despite any other mitigating factors. One thing is for certain, however: The number of federal lawsuits alleging violations of the ADA is currently accelerating at a rapid pace. Between January and August 2017, there were 432 ADA lawsuits filed in federal court—more than the total number of ADA lawsuits in 2015 and 2016 combined.

The Americans with Disabilities Act (ADA) was first passed in 1990. Both sites include hidden same-page links at the top of the page for skipping to particular content. The CDC site includes five of these links, roughly corresponding with each of the landmark regions. These links become visible when keyboard users tab into the page. These links may ultimately be unnecessary if browsers support navigation by headings or landmarks. Screen readers already provide this support, but until browsers do so natively, non-mousers with eyesight can benefit from skip links like the ones on these government sites.

Most recently, however, pizza chain Domino's has been brought under suit for their website not being accessible for specialty ordering. The U.S. Supreme Court refused to review the case, instead upholding the decision of the 9th U.S. Circuit Court of Appeals who said the “alleged inaccessibility of Domino’s website and app impedes access to the goods and services of its physical pizza franchises—which are places of public accommodation.”


These impressive statistics show how invaluable a well-designed, modern website truly is. The Americans with Disabilities Act (ADA) prohibits discrimination against people with disabilities in several areas, including employment, transportation, public accommodations, communications and access to state and local government’ programs and services. As it relates to employment, Title I of the ADA protects the rights of both employees and job seekers. The ADA also establishes requirements for telecommunications relay services. Title IV, which is regulated by the Federal Communications Commission (FCC), also requires closed captioning of federally funded public service announcements.
In short, the ADA is meant to protect disabled individuals as they go about their daily lives. These regulations ensure that people with disabilities are not denied entry into the above places or denied services by a company due to their disability. It is important to note that these regulations are now applicable to services that are provided online or through other digital formats. For example, if a company accepts job applications online, then it must ensure that a person with a disability can also apply for the job online. In other words, it is illegal to have barriers on the website that would keep the disabled individual from successfully completing their application. Fortunately, the ADA guidelines help to remove barriers and ensure that the Internet remains a space that people of all backgrounds and disabilities can use.
Imagine struggling to do something as simple as navigating and reading a website, when you’re suffering from Glaucoma, Cataracts, Macular degeneration, Retinal disorders, Refractive errors, Optic nerve disorders, and other eye issues. Reading the text in order to gain knowledge and information, would be tiring at the least. Your website doesn’t need to be like that, in fact, your website can be a pleasant experience where the visually impaired can easily zoom in and out on every page or, the text to speech feature will convert to the audible voice that you are listening to right now.
In court, Netflix tried to argue that websites should not be part of ADA compliance regulations, as there is no physical structure / location. They also argued that websites should not be in scope of ADA as there is no public component (the original ADA compliance law specifically called out that ADA rules apply primarily to services, locations, and products that are supposed to be open to the public).

Talk to your web designer about other techniques that will make your site more user-friendly for people with disabilities. Worried that’s not in your budget? Consider the fact that DOJ fines start at $75,000. And it's still yet to be determined if a non-compliant website is liable for one fine or will be charge per page for each violation. As the recent lawsuits illustrate, though, settlements quickly add up into the millions.
The Justice Dept. said it would issue new regulations, so most businesses waited to see what they would say. However, Vu believes it will be a while before the new regulations are released because of what the Justice Dept. said in a recent case. MIT and Harvard were sued over captioning of videos, and the schools wanted the judge to stay the case until the new regulations were released. The Justice Dept. told the judge not to stay the case because the new regulations could take a while to be released.

When you insert an image into a post or page, consider providing a rich description for the caption that will improve the reading experience for everyone, but especially folks who can’t see the image. Be creative. Instead of “My son on his swing,” try “My son is playing on his favorite swing. His face is filled with pure joy on a beautiful Spring day. Perfection.” The goal here is to convey the feeling of the image.

The Department of Justice may file lawsuits in federal court to enforce the ADA Compliance, and courts may order compensatory damages and back pay to remedy discrimination if the Department prevails. Under title III, the Department of Justice may also obtain civil penalties of up to $55,000 for the first violation and $110,000 for any subsequent violation of ADA Compliance.
